Terms & Conditions

Last updated: January 1, 2025

Welcome to Pizza Catering Mobile Pizzeria (referred to as "the Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website located at www.roundstablepiza.rest (the "Site") and your engagement with our mobile pizza catering services for weddings, corporate events, birthdays, private parties, and other functions.

By accessing this website, browsing its content, or executing a service agreement with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must immediately cease using our Site and refrain from booking our services.

1. Eligibility and Acceptance

To use our website and services, you must be at least 18 years of age or have the legal capacity to enter into a binding contract. By engaging our services, you represent that you are of legal age, that all information you provide (including your name, billing address, event location, and contact details) is accurate and complete, and that you will maintain the accuracy of such information throughout the duration of your booking. If you are booking on behalf of a company, organization, or another individual, you warrant that you have the authority to bind them to these Terms.

2. Description of Services

Our Company provides premium mobile pizza catering services featuring wood-fired pizzas prepared on-site by our professional chefs. Our "Round Table Pizza" experience includes but is not limited to: event set-up, fresh ingredient preparation, pizza cooking service, serving, and breakdown. We serve the area surrounding Jimmiemouth, SC, and provide catering to various public and private venues. We reserve the right to refuse service in locations that are geographically inaccessible, lack necessary utilities (clean water, electricity), or pose safety concerns for our staff and equipment.

3. Booking, Quotations, and Contracts

All catering bookings are subject to our acceptance and confirmation. A quotation provided by us (verbally, via email, or on the website) is an invitation to treat and not a guarantee of prices or availability. To formally book our services, you must:

Once the deposit is paid and the contract is signed, the agreement becomes binding on both parties. The remaining balance is due in full no later than seven (7) calendar days before the scheduled event date. If final payment is not received by the due date, we reserve the right to cancel your booking and retain the deposit as liquidated damages.

4. Client Responsibilities and Event Venue Requirements

To ensure a smooth and safe catering experience, you, the client, agree to provide or arrange the following conditions at the venue on the event day:

5. Guest Count and Menu Changes

Your quoted price is estimated based on a specific guest count. If you anticipate an increase in final guest numbers, you must notify us no less than 5 business days before the event. We will provide an adjusted final invoice. A decrease in guest count by more than 10% of the original estimate does not reduce the total contract value, as we have committed to buying ingredients and allocating staffing resources. All menu customizations, dietary allergy plans, or substitutions must be finalized at least 7 days before the event. On-the-day menu changes cannot be accommodated.

6. Payment Terms and Pricing

All prices are quoted in US Dollars and are inclusive of all applicable taxes unless otherwise stated. We accept payments via major credit cards (Visa, MasterCard, Amex) and secure bank transfers. The deposit structure is as follows:

Failure to pay the final balance on time constitutes a material breach of contract and we may immediately terminate services without any obligation to refund the deposit.

7. Site Usage and Intellectual Property

All content on our website, including logos, images (e.g., logo.jpg), photos of our pizzas, markdown documents, graphics, text, and the "Round Table Pizza" visual brand, are the exclusive property of Pizza Catering Mobile Pizzeria. You are granted a limited, revocable, non-exclusive license to access and view the site for personal, informational use. Unauthorized copying, reproduction, distribution, or modification of any website content for commercial purposes is strictly prohibited and may result in legal liability. While on our physical catering site, you may take photos of our mobile unit for personal use; commercial filming requires prior written consent from us.

8. Food Safety, Allergies, and Dietary Requirements

We adhere to the highest food safety standards and hold all relevant health department certifications. However, our food (pizza) is prepared in an environment where gluten, dairy, nuts, shellfish, and other allergens may be present. You acknowledge that we cannot guarantee an allergen-free environment. It is your duty to inform us of any known food allergies of your guests at least 7 days before the event. We will make reasonable efforts to accommodate these needs (e.g., providing a separate vegan or gluten-free pizza). The client takes full responsibility for communicating allergen information to their guests and indemnifies us against any allergic reactions that occur due to ingredients not notified or due to cross-contamination.

9. Liability and Force Majeure

Our total aggregate liability for any claim arising out of the contract, whether in contract, tort (including negligence) or otherwise, shall be limited to the total amounts paid by you to us for the specific event. We shall not be liable for any indirect, incidental, special, or consequential damages (including, but not limited to, loss of profits, loss of reputation, or cost of procuring substitute goods). We shall not be held responsible for failure or delay in performance of our obligations if such failure arises from a "Force Majeure" event: fire, flood, weather, pandemics, acts of God, war, civil unrest, strikes, labor disputes, power failures, or government restrictions. If a Force Majeure event occurs, we will offer to reschedule your event to a future date within 12 months. If we reschedule and you cancel the rescheduled date, no refund will be issued, but the deposit may be applied as credit for a new event.

10. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the website will be uninterrupted, secure, or error-free. Any errors in the food taste or presentation cannot be subject to demand for a complete refund, but we will make reasonable alterations to rectify an issue during the event.

11. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Pizza Catering Mobile Pizzeria, its owners, employees, chefs, volunteers, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (i) your use of the website; (ii) your event and venue conditions; (iii) your violation of these Terms; (iv) your violation of any third-party rights or regulations.

12. Termination by Us

We reserve the right to terminate or suspend your access to our website or cancel a catering booking immediately, without notice and liability, if you breach any of the provisions of these Terms. We may also cancel a booking if we discover fraudulent reservation attempts or if you misrepresent the nature of the event (e.g., claiming a small private party but expecting festival-level production). In termination cases, all payments made by you are non-refundable and you remain liable for all outstanding amounts.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of laws provisions. Any legal suit, action, or proceeding with respect to these Terms or your use of the website shall be instituted exclusively in the state or federal courts located in South Carolina. You waive any objection to the jurisdiction and venue of such courts. Before initiating any formal legal action, both parties agree to attempt a good-faith resolution through mediation for a period of 60 days. If unresolved, arbitration, as per rules of the American Arbitration Association, shall be the final and binding jurisdiction, except where a statutory right overrides this clause.

14. Amendments

We may revise and update these Terms periodically at our sole discretion. By continuing to use our website and services after any changes are posted, you agree to the updated Terms. The revised "Last Updated" version at the top will indicate the effective date. You are advised to review our Terms regularly.

15. Entire Agreement

These Terms, together with our Privacy Policy, the Refund Policy, and any catering service agreement signed with you, constitute the entire agreement between you and Pizza Catering Mobile Pizzeria. They supersede all prior negotiations, representations, proposals, and agreements (oral or written) relating to our services.
